DePuy Hip Recall Necessitates Complicated Revision Surgeries

Patients who have received DePuy hip replacements using the ASR Hip Resurfacing system and the ASR XL Acetabular system after July 2003 may be subject to serious side effects and a DePuy Hip Recall. Side effects of the breakage of the ASR Hip Resurfacing system and the ASR XL Acetabular system can include infection, inflammation due to metal debris, bone fracture and severe pain. The metal debris can also enter the bloodstream, resulting in the destruction of tissue and bone around the implant, metal poisoning and potentially cancer. A second hip replacement surgery becomes necessary. These surgeries, called ‘revision surgeries’ are often risky and complicated.

What the DePuy Hip Recall means to you:

If you’ve received DePuy hip replacements using the ASR Hip Resurfacing system and the ASR XL Acetabular system after July 2003, you need to be observed regularly by a physician to ensure your prosthetic is functioning, whether you have already experienced side effects or not.

DePuy has promised on its website, that it “…intends to cover reasonable and customary costs of treatment if you need services associated with the recall of ASR, including revision surgery if it is necessary.” Elsewhere on its site, DePuy names specific out-of-pocket expenses that it may deem “reasonable,” including lost work time and travel expenses.

But the orthopedic manufacturer has yet to provide any details on how, or even if it intends to compensate you for the pain and suffering your DePuy hip replacement may have caused. And even worse, DePuy will not pay you a cent until you call their claim center and sign a medical release form. In other words, only after you speak to a representative who owes you no duty of confidentiality and waive your rights will DePuy even consider compensating you. To protect your interests, you should not call DePuy or sign any document the company provides without first speaking with a DePuy Hip Replacement Lawyer. Legally, you’re entitled to compensation for the pain and expense you’ve incurred as a result of your DePuy Hip Replacement failure. In a typical product liability case (such as when a defective medical device has injured you), a victim can potentially recover a combination of economic damages (such as medical bills and lost wages) and non-economic damages (such as pain and suffering).
